Who we are
Barkada Systems is a software studio operated in Sweden.
In these terms, “we,” “us” and “our” mean Barkada Systems. “You” means the person or organization buying from us or using what we make.
What these terms cover
They apply to everything we sell and operate: our own web products, and work we do for clients.
Orders and payment
Prices are shown before you pay, and include applicable tax unless we say otherwise. Payment is taken at the time of order by our payment processor, Stripe; card details never reach us.
Charges appear on your statement as BARKADA SYSTEMS.
Delivery
Delivery times are stated on the page for each service. If we can't deliver inside the stated time, we'll email you rather than leave you waiting.
Refunds and cancellation
We refund in full where a service isn't delivered, is materially different from what we described, or where we conclude we can't perform it properly.
Consumers in the EU, EEA and UK. You normally have 14 days to withdraw from a distance contract. Where a service is performed on request and starts immediately, you're asked to consent to that at checkout, and to acknowledge that you lose the right of withdrawal once it has been fully performed. Until then you can cancel for a full refund by emailing us. None of this affects your statutory rights if a service isn't performed as described.
Acceptable use
Don't use what we make unlawfully, to harass anyone, or in a way that infringes someone else's rights. We can decline or cancel an order, with a refund, where we believe it would be used that way.
Intellectual property
We keep ownership of our services, software and materials. Once you've paid for a deliverable you can use it for your own business or personal purposes; you can't resell it or publish it as your own work.
For client engagements, ownership is whatever that engagement's agreement says.
Accuracy
We take care over what we produce, but we don't warrant that it's complete or free of error, particularly where it summarizes third-party or public sources. Tell us about a factual error and we'll correct it.
Liability
Our services are provided as is. To the extent the law allows, our total liability for any claim relating to a service is limited to what you paid for it, and we aren't liable for indirect or consequential loss.
Nothing here excludes or limits liability that can't lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
Data protection
We handle personal data as set out in the privacy policy of the service you bought, and only where we have a lawful basis for it. Write to hello@barkadasystems.com with any data protection question.
Changes
We may update these terms. The version in force when you place an order is the version that applies to that order.
Governing law and disputes
Swedish law governs these terms, and disputes go to the Swedish courts. If you're a consumer, that doesn't deprive you of the protection of mandatory rules where you live, and you can bring proceedings there.
